MODERN UNDERSTANDING OF RECIDIVISM IN THE FRAMEWORK OF THE CRIMINAL LAW FIELD

Abstract (English):
The article analyzes the concepts of recidivism and penitentiary recidivism, identifies legislative contradictions in the definition of recidivism and the procedure for sentencing when it is committed, and examines the dynamics of recidivism. The author comes to the conclusion that Article 18 of the Criminal Code of the Russian Federation has many contradictions that affect the number of crimes recognized as committed in case of recidivism. The measures to eliminate the existing legal shortcomings are proposed, which make it possible to change the attitude towards the modern understanding of recidivism and the imposition of punishment when it is committed.
