The article is devoted to the study of the legal aspects of bringing to justice persons who use their official position to organize a channel of illegal migration. The research is based on an analysis of current Russian legislation, international norms and judicial practice. Particular attention is paid to changes in legislation that relate to the qualifying features of the crime in question, as well as the specifics of law enforcement practice. The reasons for the illegal behavior of officials, including corruption motives and shortcomings of the state control system, have been studied in detail. Proposals are being put forward to improve legislation in order to increase the effectiveness of countering illegal migration and ensure that perpetrators are inevitably punished.
