The article discusses the problems of qualification of a crime involving criminal liability for the illegal implementation of activities for the repayment of overdue debts of individuals. The article describes the objective and subjective signs of a crime involving liability under Article 172.4 of the Criminal Code of the Russian Federation, and examines in detail the issue of the subject of the crime. In order to determine the size of the act provided for in Article 172.4 of the Criminal Code of the Russian Federation, proposals are being formulated to clarify the resolution of the Plenum of the Supreme Court of the Russian Federation in order to unify judicial practice and increase the effectiveness of countering the type of criminal activity in question.The need for legislative consolidation of the concept of "overdue debt" is pointed out.
