In 2018 there will be the 20th anniversary of the transfer of the penal system to the competence of the Ministry of justice of the Russian Federation. This is a good opportunity to turn to the historical experience of legal and scientific solution of this issue during the Russian Empire period, namely to 1895 - the time of the first transfer of the penitentiary system to the Ministry of justice. The transition of the prison system to the jurisdiction of the Ministry of justice has created favorable conditions for overcoming the crisis of the prison system. In the person of the Minister of justice two important principles were united which were necessary for the imprisonment execution, the humanization of the prison, i.e. the prison reform implementation and the new legislative basic creation.The penitentiary policy on the criminal penalties execution at the new stage of its implementation becomes more balanced. This is manifested in the action coordination between the various law enforcement agencies: the court, the Prosecutor’s office, the prison inspectorate, the police, the guardianship committees for the accurate legislation application, as well as the creation of conditions for sentence execution.
