The article identifies and considers the problems of regulation of the use of physical force, special means and weapons by penal system staff applied to convicts as se- curity measures in the penal enforcement legislation. The comparative analysis of provisions of articles 29, 30 and 31.2 of the Law of the Russian Federation “On the organizations and bodies executing criminal penalties in the form of imprisonment” and article 86 of the Penal code of the Russian Federation regarding physical force application basis to condemned, special means and the weapon is carried out. As a result it is established that provisions of the Law of the Russian Federation “On the organizations and bodies executing criminal pun- ishments in the form of imprisonment” significantly differs from article 86 of the Penal code of the Russian Federation. In the first act it is spoken, for example, about possibility of appli- cation of a precautionary shot, protection of the objects of penal system and suppression of administrative offenses (this is not presented in the Penal code of the Russian Federation), and vice versa. It is concluded that article 86 of the Penal code of the Russian Federation should exclude the list of reasons for the use of physical force, special means and weapons by staff of the penal system.
