POSITIVELY CHARACTERIZED CONVICTS IN THE PROGRESSIVE RESOCIALIZATION PROGRAM

Abstract (English):
The article deals with the stages of the progressive system of resocialization in the process of criminal prosecution: criminal proceedings, serving sentences and consequences of conviction. The existing norms of criminal law, criminal procedural law and penal law provide for elements of progressive resocialization system. The effect of these norms depends on the behavior of prosecuted persons and it provides an incentive to observe the established laws.During the criminal proceedings the criminal law norms and procedural regulations are analyzed. It is noted that some norms are presented as elements of progressive system of the initial stage of resocialization. It is important that at the end of the criminal procedure the legislator should focus on the development of a program aimed at correction and implementation of a set of resocialization measures of criminals.The foreign practice concerning the organization of convicts’ correction at the initial stage of serving a sentence is analyzed. The article considers the experience of entrance sections in Germany where convicts are admitted to prison for a comprehensive examination by field specialists. Its purpose is to determine the type of a correctional institution and the develop- ment of an appropriate program for resocialization and correction taking into account individual characteristics.The emphasis is made on the fact that in Russia the institute of semi-free regime as a transitional phase from isolation to freedom and on that ground it is proposed to transfer positively characterized convicts to a colony settlement the year before parole. In addition, it is interesting to create preferential (for adults) and open conditions for serving sentences in places of deprivation of liberty which would involve a semi-free regime.At the final stage of resocialization a proposal is put forward to eliminate additional duties and restrictions on positively characterized convicts which, in turn, minimizes moral psychological barrier and eliminates the legal consequences associated with a criminal record.
