PROBLEMS OF ENSURING THE RIGHTS AND FREEDOMS OF CONVICTED PERSONS IN CORRECTIONAL INSTITUTIONS OF RUSSIA: PROCEEDINGS OF THE HUMAN RIGHTS COMMIS- SIONER OF RUSSIA

Abstract (English):
There are a number of urgent problems in penal system institutions related to the observance of the rights and freedoms of convicted persons, such as: illegal use of physical force and special means by penal system staff; inadequate medical care of convicted persons; unsatisfactory conditions of detention in correctional institutions; transfer to a correctional institutions located near the place of residence of a convict or residence of his relatives.In order to prevent the illegal use of physical force, special means and firearms in December 2016 they have made significant changes in federal law of the Russian Federation “On institutions and bodies executing criminal penalties of imprisonment” and in 2017 res judicata order of the Ministry of Justice of Russia “On approval of the procedure for the carrying and use of firearms by the penal system staff”. These innovations regulate a rather strict procedure for theuse of physical force, special means and firearms by the penal institution, and the authors also pay attention to the algorithm and terms of actions after the use of these means.To provide adequate medical care and to attract a wider range of specialists in various fields in correctional institutions the mechanism of remote treatment is being tested in the penal system.The amendments to the Penal code of the Russian Federation and the introduction of new internal regulations of correctional institutions are aimed at humanization of detention conditions in correctional institutions of Russia in accordance with international standards.Problems of detention of a convicted person in a correctional institution located near the place of his residence before the conviction or the residence of his relatives, or detention of a foreign convicted person in a correctional institution of the Russian Federation located near the diplomatic mission and the consular office not far from the border with his native state, or not far from the airport having a direct air communication with the state of citizenship or permanent residence of a convict, can be solved by creating of correctional institutions of a hybrid type with several types of regime in all subjects of the Russian Federation, that is a single institution with a mixed regime of punishment.
