Abstract (English):
The article contains the text of the author’s expert opinion at the request of the Constitutional Court of the Republic of Kazakhstan, on the basis of which paragraph 1 of part 8 of Article 72 of the Criminal Code of the Republic of Kazakhstan was declared unconstitutional on July 11, 2024 in terms of prohibiting the parole of convicts who had the death penalty commuted to life imprisonment by way of pardon.
