The article examines the concept and grounds for exemption from punishment due to illness, regulated by domestic criminal legislation. The decisions of the courts of first instance and the appellate instances in cases of release from punishment due to illness are analyzed. As a result, it is concluded that the unconditional nature of the release of persons with mental disorders and conditional, in terms of the release of patients with other serious illnesses. It has been established that it is necessary to review the main provisions of criminal legislation regarding the establishment of criteria that are particularly taken into account when deciding whether to be released from punishment due to another serious illness, as well as the implementation of post-penitentiary support for persons released from punishment on this basis.
