Examines the issues connected with the understanding of the decisions and determinations of the Constitutional court of the Russian Federation as the formal sources of penal law. The availability of admitting the decisions and determinations of the Constitutional court of the Russian Federation as the sources of the branch of penal law is argued. Attention is paid to the existing interrelations between the legal doctrine and the decisions and determinations of the Constitutional court of the Russian Federation as the sources of law. Attention is focused on the actual problem of the mechanism of executing the decisions and determinations of the Constitutional court of the Russian Federation which contain regulations of penal law.
